Apple Opens Legal Battle With OpenAI Over Trade Secrets

Apple’s legal battle with OpenAI is bringing one of the AI industry’s highest-profile relationships into court. In a federal lawsuit filed in Northern California, Apple alleges OpenAI obtained confidential information related to unreleased technologies, engineering processes, and product development. OpenAI denies the allegations.

The filing comes as OpenAI continues building its consumer hardware business following its acquisition of Jony Ive’s startup io. Apple claims former employees disclosed proprietary information during OpenAI’s recruiting process and after joining the company. OpenAI has denied the allegations, stating it does not use competitors’ trade secrets and remains focused on developing its own technology.

As part of the filing, Apple is seeking damages, court orders preventing the use or disclosure of the alleged trade secrets, the return of materials it says contain confidential information, and preservation of evidence during litigation. The allegations remain unproven, and the court has not made any findings in the case.

Why It Matters: AI development is expanding into hardware at the same time companies compete for experienced engineering talent. The lawsuit brings employee mobility and the handling of proprietary product information into focus as organizations build new AI products.

  • Recruiting Practices Receive Significant Attention: OpenAI Chief Hardware Officer Tang Tan is a central figure in the complaint. According to the filing, Apple alleges Tan asked Apple employees interviewing with OpenAI to discuss confidential work related to unreleased products and engineering decisions, and to bring Apple hardware components to interviews for “show and tell” sessions. Apple also alleges departing employees received guidance on avoiding the company’s security procedures before leaving.
  • Former Apple Engineer Is Also Named: The lawsuit names former Apple engineer Chang Liu as a defendant. Apple alleges Liu did not return an Apple-issued laptop after leaving the company and downloaded confidential engineering documents before his departure. According to the complaint, those materials included technical specifications, engineering presentations, and information related to unreleased products. Apple also alleges Liu shared confidential information with Apple employees preparing to interview with OpenAI.
  • Hardware Development Is Included in the Complaint: Alongside its recruiting claims, Apple alleges OpenAI sought confidential information related to product design, component selection, and manufacturing processes while developing consumer hardware. Apple contends that information became part of those efforts, an allegation OpenAI denies.
  • Manufacturing Partners Also Feature in the Complaint: Apple alleges OpenAI used a proprietary Apple metal-finishing technique during hardware development. According to the filing, a manufacturing partner believed Apple had authorized its use.
  • The Case Now Moves Through the Courts: Before filing suit, Apple says it contacted OpenAI about its concerns but did not receive a response. The company is seeking damages, injunctive relief, the return of materials it alleges contain confidential information, and preservation of evidence during litigation. OpenAI denies the allegations, and the court has not made any findings in the case.
