Legislation to Rein in AI’s Use in Hiring Grows

Several states are working to require that companies take action around AI's use in the hiring process.

A growing number of US states are considering or have already passed legislation to regulate the use of artificial intelligence (AI) in the hiring process, in an effort to prevent bias against certain groups.

Why it matters: The proposed laws would require companies to disclose their use of AI and the data sets used to train the algorithms, and to allow job applicants to request an explanation if they are rejected due to an AI decision. Supporters say the measures could help reduce discrimination against minority groups and create a fairer hiring process.

  • At least five states have considered or passed laws related to AI hiring: Illinois, New York, Michigan, Minnesota, and California.
  • Supporters of the legislation argue that AI can perpetuate biases, such as gender and race discrimination, and that more transparency is needed to ensure fairness in hiring.
  • Opponents argue that AI can help reduce human biases and streamline the hiring process, and that overly restrictive legislation could stifle innovation and job creation.
