NFL’s 49ers Resolve Data Breach Litigation

The San Francisco 49ers have agreed to a $610,000 settlement to address multiple consolidated class action lawsuits stemming from a February 2022 cyberattack. This breach compromised the personal and financial information of over 20,000 individuals, including customers, employees, and their dependents.

The proposed settlement, pending court approval, aims to compensate affected individuals and implement enhanced cybersecurity measures to prevent future incidents. The agreement outlines specific benefits for class members and details the steps the organization plans to take to bolster its data protection protocols.

  • Scope of the Breach: The February 2022 cyberattack on the San Francisco 49ers compromised sensitive information, including names, dates of birth, Social Security numbers, and details about employees’ immigration statuses and their dependents.
  • Settlement Details: The $610,000 settlement is designed to compensate approximately 20,930 U.S. residents who received notification from the 49ers about the breach. Affected individuals may be eligible for up to $7,500 each for documented out-of-pocket losses plausibly arising from the breach.
  • Claim Process: Class members will need to submit a valid claim form, either by mail or online through the official settlement website once it is established. The claim submission period will be open for 90 days following the mailing of settlement notices
  • Additional Compensation: Beyond individual claims, any remaining settlement funds will be distributed on a pro-rata basis among class members, with California residents receiving three shares each. Notably, class members do not need to file a claim to receive this additional payout.
  • Enhanced Cybersecurity Measures: As part of the settlement, the 49ers have committed to implementing specific measures to strengthen their cybersecurity infrastructure, aiming to better protect their network and prevent future breaches.
